Terms of use and privacy.

1. The service

Ultimate DSP is web software and a companion driver app provided by Ultimate DSP ("we"). By creating an account you agree to these terms on behalf of your delivery service partner business ("you").

We may update the service at any time. Material changes to these terms are announced in the product at least 30 days before they take effect.

2. Accounts and roles

The Owner account controls the DSP account, its users and billing. Ownership moves only by explicit transfer. You are responsible for who you invite and for the posts you assign them.

Driver app accounts are created by invitation from a driver record. Drivers see their own score, coaching, surveys and DSP contacts, and nothing about other drivers.

3. Fees

The fee is $1 per active driver per month, or $0.75 per active driver per month billed annually. An active driver is a Delivery Associate on your driver list during the billing month. Driver app accounts are not billed.

The first 45 days are free and require no payment method. Monthly plans may be cancelled at any time and end at the close of the paid month. Annual plans are non-refundable after the first 45 days.

4. Your data

Everything you upload, including Amazon exports, driver lists, schedules, punches, coaching records and invoices, remains yours. We use it to provide the service, to support you, and in aggregated, de-identified form to improve the product.

You may export your data at any time. On termination we delete it within 90 days unless you ask us to hold it.

5. Acceptable use

You agree not to upload data you have no right to hold, to attempt to access another DSP's data, or to resell the service. You are responsible for complying with employment and privacy law that applies to your drivers.

6. Warranty and liability

The service is provided as is. Ultimate DSP is sold with a Fantastic+ guarantee; its terms, conditions and remedy will be set out here before publication (TODO: owner to supply guarantee terms). Beyond that guarantee we do not warrant any particular Amazon Scorecard result, invoice recovery or profit. To the extent permitted by law, our liability is limited to the fees you paid in the twelve months before the claim.

7. Independence

Ultimate DSP is built by an independent Amazon DSP. It is not affiliated with, endorsed by or connected to Amazon.com, Inc. or its subsidiaries. Amazon is a trademark of its owner.

1. What we collect

Account data: names, work emails, phone numbers and roles of your users. Driver data you upload or enter: names, contact details, schedules, punches, routes, scorecard and telematics events, coaching records, documents. Usage data: pages visited and actions taken inside the product, used to keep it working and improve it.

2. How we use it

To run the nine portals and the driver app, to send the reminders and messages you configure, to bill you, and to support you. We do not sell data and we do not use driver data for advertising.

3. Who we share it with

Sub-processors that host the service, send SMS and email on your behalf, and process payments, each bound by contract to use the data only for that purpose. Payroll providers you connect, such as Paycom or ADP, receive only the exports you send.

4. Drivers

Drivers can see their own record in the Ultimate DA app. Requests from drivers to access or correct their data should go to their DSP, which controls that data; we assist the DSP in responding.

5. Retention and security

Data is kept for the life of your account and deleted within 90 days of termination unless you ask otherwise. Data is encrypted in transit and at rest, and access inside our company is limited to staff who need it to support you.
